Key deadlines include the completion of written discovery by February 15, 2024, general causation expert discovery by August 30, 2024, and hearings on general causation (Daubert) in late January 2025, which is highlighted as crucial for the litigation’s outcome.

April 2024

On April 29, 2024, a Gardasil lawsuit was filed against Merck & Co., Inc. and Merck Sharp & Dohme LLC. The lawsuit is about Angela Walker, who got seriously hurt after getting the Gardasil vaccine. June 2024

Lawyers are preparing federal Gardasil vaccine lawsuits for early test trials to see how juries might react to the evidence. However, the first trial will likely happen in California, involving a teen girl who became bedridden after receiving the HPV vaccine.

There are about 200 federal cases centralized in North Carolina, overseen by Judge Kenneth D. Bell. He ruled that claims against Merck for not warning about side effects can proceed. The parties are now preparing 16 “bellwether” cases for early trials to help gauge jury reactions.

A status report indicated that many depositions have been completed, but plaintiffs recently got an extension for discovery deadlines. The first federal trial’s schedule may be discussed on June 13.

Besides federal cases, there are seven claims in California, with the first trial set for October 7, 2024. Merck wants to delay it. One case involves Jennifer Robi, who suffered severe health issues after a Gardasil injection. Her mother testified about their experience, saying the vaccine ruined Jennifer’s life.

On June 12, 2024, Shyla Smith, a young woman from West Virginia has filed a Gardasil vaccine lawsuit against Merck & Co. after experiencing health issues after the vaccination. She received the HPV vaccine at ages 13 and 14, and later developed lupus, Tourette’s syndrome and other debilitating conditions. Smith alleges that Merck did not properly warn about the potential for serious, permanent autoimmune injuries from the vaccine.

This case is part of a larger group of Gardasil lawsuits that have been combined into a federal multidistrict litigation (MDL) for coordinated pretrial proceedings. Early test trials are being planned to help determine how juries might respond to the evidence.

July 2024 

In California, a trial involving Jennifer Robi, who claims she developed heart problems and nerve pain after a Gardasil injection, is set for October 7, 2024. Despite Merck’s attempts to delay, the trial will proceed as scheduled. Other trials are planned for early 2025.

A case management conference with Judge Bell is scheduled for July 18, 2024, to discuss the status of other California cases, Merck’s motions to dismiss some cases, and requests for more time to depose witnesses. Depositions for the 16 federal bellwether cases are ongoing, with initial expert disclosures due by August 19, 2024. The court will later narrow these 16 cases to a smaller group for the first federal trials. If no Gardasil settlements are reached, individual cases may go to trial across the country.

August 2024 Update

Before filing a lawsuit in federal court, families must seek compensation from the U.S. Vaccine Court under the National Vaccine Injury Compensation Program. If the Vaccine Court does not resolve the case within eight months, a civil lawsuit can be filed. However, many Gardasil claims are still in the Vaccine Court process, and some lawsuits were dismissed because they were not filed on time or not filed at all with the Vaccine Court.

Judge Kenneth D. Bell, Sr., who oversees the Gardasil lawsuits in federal court, has dismissed four cases based on these timeliness issues. The judge stated that he did not have the authority to overturn the Vaccine Court’s decisions.

As per the latest Gardasil MDL update, there are around 204 pending lawsuits to be resolved.

October 2024 Update

Around 200 new lawsuits were still waiting to be resolved in the MDL.

The CDC highlights a concerning drop in the number of children receiving the Gardasil vaccination. This decrease in number linked to the COVID-19 pandemic and difficulty accessing medical care stands out, as other vaccine rates have remained stable. Based on a survey of over 16,000 teens, the CDC’s report reveals that children born in 2010 have a 10% lower chance of receiving a full Gardasil vaccination compared to those born in 2007.

Gardasil has been promoted by Merck for many years. However, Merck now faces numerous lawsuits claiming that the vaccine’s risks, including autoimmune disorders and neurological issues, were not adequately disclosed.

In September 2024, most of the lawsuits are being handled in federal court under Judge Kenneth D. Bell. Pretrial discovery is ongoing for 16 selected cases, with the first federal trials expected in late 2025 or early 2026. California will see the first Gardasil trial in October 2024, with more scheduled in early 2025. These trials are expected to reveal more about what Merck knew about the vaccine’s side effects and may influence future settlements.

November 2024 Updates

There are around 207 Gardasil lawsuits in the MDL are awaiting resolution.

A woman from Indiana, Monique Padfield, has filed a lawsuit against Merck, claiming the vaccine caused her severe health problems. She brought the case in October 31, 2024 in the U.S. District Court for the Western District of North Carolina.

Padfield received her first Gardasil dose in March 2021 at age 40, followed by two more doses in May and September. By 2022, she developed seizures and was diagnosed with chronic pain syndrome and functional neurological disorder. In 2023, doctors found abnormal antibodies in her blood, indicating an autoimmune reaction. Her lawsuit accuses Merck of negligence, fraud, and failing to warn about the vaccine’s risks.

On November 1, 2024, Merck filed a motion asking the judge to dismiss all 16 bellwether cases. The company argues that federal law prevents these lawsuits because the FDA requires strong scientific evidence before it approves changes to vaccine warning labels, and Merck claims it lacked the evidence to justify such updates.

Judge Bell has not yet ruled on Merck’s motion, and plaintiffs have not responded. If the cases are not dismissed, some of the 16 cases will move forward for trials, likely starting in late 2025 or early 2026.

January 2025 Updates

There is a slow growth in Grdasil lawsuits. As of now, 218 lawsuits are pending in the MDL.

Gardasil vaccine lawsuit 2023

On December 2, 2022, two HPV vaccine injury lawyers submitted a bellwether plan. The plan is to choose 16 cases and find the fact discovery.
