Bacterial Contamination

What is the lawsuit against Fabuloso? The main cause of the Fabuloso lawsuit is Pseudomonas aeruginosa, a type of bacteria known to cause serious infections. Infections caused by Pseudomonas aeruginosa can affect the blood, lungs, skin, and other body parts. These infections often occur in environments like hospitals, hot tubs, and swimming pools.

Pseudomonas aeruginosa can lead to severe health issues, particularly in individuals with weakened immune systems. These bacteria are widespread in the environment, particularly in produce, soil, and water. Bacteria can enter the body through the eyes, the skin, or inhaling.

The presence of Pseudomonas aeruginosa and Pseudomonas fluorescens in household cleaning products like Fabuloso raises significant health concerns. The issue affected approximately five million bottles of Fabuloso multi-purpose cleaners.

The affected Fabuloso products were found to include Pseudomonas fluorescens in addition to Pseudomonas aeruginosa. Although this kind is not thought to be as dangerous as P. aeruginosa, respiratory illnesses have been repeatedly associated with it.

What company owns Fabuloso? Colgate Palmolive is the company that owns Fabuloso products.

Between December 2022 and January 2023, the Fabuloso cleaners, which were produced by the New York-based Colgate-Palmolive Company, were disseminated for sale on Amazon.com and other large shops such as Sam’s Club, Walmart, The Home Depot, Dollar General, and Family Dollar.

Fabuloso cleaning products recall

On February 8, 2023, Colgate Palmolive recalled nearly five million bottles of Fabuloso Multi-Purpose Cleaners due to Pseudomonas bacterial contamination. The U.S. Consumer Product Safety Commission (CPSC) announced this recall, advising consumers to immediately stop using the affected cleaning liquids.

According to Fabuloso Recall, these are the affected products:

Federal health officials are advising customers not to use the recalled cleaning solution. They are urging consumers to take immediate action by destroying the bottles still containing the cleaning solution.

Consumers take a snap of the product’s lot code and UPC and then throw it out in its container along with regular household trash.

For those who have purchased the affected product, Colgate-Palmolive Company is offering a comprehensive refund through their consumer recall form. This form serves as a crucial step in ensuring that consumers are promptly compensated for their purchases.

The Consumer Product Safety Commission (CPSC) is sounding a serious note of caution, emphasizing that even though there have been no reported illnesses associated with the recalled Fabuloso, staying safe is important. The potential threat lies in the presence of bacteria, which, if encountered, could lead to life-threatening infections.

Anyone falling into these high-risk categories is strongly advised to seek immediate medical attention.

Fabuloso Class Action Lawsuit

The bacterial contamination issue began with a complaint filed by Elizabeth Dixon in the U.S. District Court for the Western District of North Carolina on February 10, 2023. This lawsuit sought class-action status, aiming to represent potentially millions of consumers.

Elizabeth Dixon sues Colgate-Palmolive and associated entities over their Fabuloso brand cleaning products.

The Fabuloso recall lawsuit alleges that these products, sold nationwide, contain harmful bacteria (Pseudomonas aeruginosa and Pseudomonas fluorescens), posing serious health risks, especially to immune-compromised individuals.

The lawsuit against Fabuloso states that the company failed to disclose this risk on product labels, deeming the advertising and marketing deceptive. The plaintiffs seek compensation for the misleading representation of the product’s safety and the health risks posed by the undisclosed bacteria.

These consumers are believed to have paid a premium for products that unknowingly contained this potentially life-threatening bacteria.

The defendants in this case include several entities under the Colgate-Palmolive umbrella: Colgate-Palmolive (America) Inc., Colgate-Palmolive Holding Inc., Colgate-Palmolive International LLC, Colgate-Palmolive Investments Inc., and Gaba Holdings Delaware LLC.

The plaintiff in this Fabuloso lawsuit alleges several causes of action against the defendants, including breach of express warranty, negligence, unjust enrichment, negligent misrepresentation, and breach of implied warranty.

The plaintiff is also asking the court to impose an injunction compelling the defendants to discontinue sales of the products until their advertising materials have been corrected.

Fabuloso Class Action Settlement

The Fabuloso class action settlement resolves a class action complaint concerning a widespread recall of Fabuloso cleaning products that were contaminated with dangerous Pseudomonas bacteria.

Nearly $2 million in Fabuloso lawsuit settlement amounts will be awarded to customers who bought Fabuloso cleaning products distributed between December 14, 2022, and November 14, 2023, according to the settlement agreement.

If you’ve been harmed by recalled Fabuloso products, it’s important to contact a lawyer to understand your legal rights. They can help determine if you’re eligible to file a Fabuloso cleaner lawsuit.

A lawyer can guide you through the legal process. Especially in cases where a class action lawsuit may be appropriate due to widespread issues. To assess the extent of the Fabuloso product injury, a comprehensive medical record review is necessary.
